Terms of Service

These Terms of Service govern the use of the Child Safe Sport platform and services. By accessing or using the platform, organisations and users agree to these terms.
Child Safe Sport provides software tools designed to support safeguarding, compliance, and reporting workflows for sporting organisations.
1. Appropriate Use & Decision-Making
The platform serves as a decision support tool. Final determinations regarding the suitability of personnel, the validity of credentials, and the resolution of reports must be made by an authorised representative of the organisation.
Users Must Not
- • Access information belonging to another organisation
- • Attempt to bypass security protections or authentication systems
- • Upload malicious software or harmful code
- • Use automated systems to scrape, copy or extract platform data
- • Upload unlawful, abusive, or misleading content
Organisations Are Responsible For
- • Managing user permissions and access levels
- • Ensuring safeguarding records are accurate and current
- • Maintaining lawful handling of personal information
- • Reviewing and responding to reports in a timely manner
- • Meeting all statutory safeguarding obligations
2. Account Security & Access
Email-Based Authentication
Because platform access is authenticated through email-based "magic links," account security is closely linked to the security of your organisation's email systems.
Users must notify Child Safe Sport immediately if they suspect unauthorised access or a security breach.
MPIO Responsibilities
Member Protection Information Officer (MPIO) accounts provide access to highly sensitive data via a master password.
Child Safe Sport cannot view or recover MPIO master passwords. MPIOs are responsible for maintaining this password securely and ensuring it is not shared or reused.
3. Intellectual Property & Asset Usage
Child Safe Sport provides a suite of proprietary assets, including but not limited to: digital kits, reporting flowcharts, induction logs, and training materials (the "Assets").
✓ Permitted Use
- • Customising and branding Assets for use within your specific organisation.
- • Downloading, printing, and distributing Assets to your own staff, volunteers, and members.
- • Retaining digital or physical copies of completed compliance records for statutory purposes.
✕ Prohibited Use
- • Reselling, gifting, or sub-licensing Assets to third-party organisations or individuals.
- • Distributing unbranded or "template" versions of the Assets outside of your organisation.
- • Removing Child Safe Sport copyright notices or branding from the base digital architecture.
All intellectual property rights in the platform, software, templates, documents, training materials, and other Assets remain the exclusive property of Child Safe Sport. Your subscription grants a limited, non-exclusive, non-transferable licence to use and modify these Assets internally within your organisation only. Organisations must not reproduce, resell, redistribute, sublicense, share, or provide the Assets, or any substantial portion of them, to third parties without prior written permission from Child Safe Sport.
4. Safeguarding Responsibilities
Child Safe Sport provides the digital framework and administrative tools necessary for managing compliance. However, the effectiveness of these tools is entirely dependent on the organisation’s internal culture, leadership, and active participation.
Platform Responsibility
We ensure the software functions as described, providing a secure place to log data, track credentials, and manage reports.
Organisation Responsibility
Organisations are responsible for actual implementation, including ensuring staff upload documents, reviewing submitted reports, and taking appropriate action on safety concerns.
Child Safe Sport cannot guarantee, monitor, or enforce the implementation of safeguarding policies within an organisation.
5. Ownership & Data Portability
Organisations retain ownership of all records and information they upload. By using the platform, you grant us a limited right to store, process, and encrypt this data to provide the service.
Right to Export: Upon termination of service, Child Safe Sport provides tools to export your records in a standard format. The organisation is responsible for the secure retention of these exported records to meet statutory requirements.
6. Availability & Subscriptions
Service Availability
We use commercially reasonable infrastructure and security practices to maintain reliability.
Service availability depends in part on our upstream infrastructure providers. Scheduled maintenance will be communicated in advance where possible.
Subscriptions
Access to paid features requires an active subscription.
If payment fails, a 7-day grace period may apply before access to certain features is paused.
7. Emergency Notice
Child Safe Sport is not an emergency response service. Reports submitted are not monitored in real time.
If a child is in immediate danger, contact emergency services (000), Queensland Police, or the relevant Child Safety authority directly.
8. Suspension or Termination
Child Safe Sport may suspend or terminate access where reasonably necessary to:
- • Address security risks or suspected unauthorised access
- • Prevent unlawful or abusive platform use
- • Respond to non-payment
- • Protect the integrity or reliability of the platform
9. Disclaimers & Limitation of Liability
No Warranty
The platform is provided on an "as is" and "as available" basis. While we work to maintain reliability and security, we do not guarantee uninterrupted, error-free, or fully secure operation.
Not Legal Advice
Child Safe Sport provides software tools to assist with safeguarding and compliance management. Use of the platform does not guarantee legal compliance or immunity from regulatory action. Organisations should obtain independent legal or safeguarding advice where appropriate.
Limitation of Liability
To the maximum extent permitted by law, Child Safe Sport is not liable for indirect, incidental, consequential, special, or punitive damages arising from use of the platform.
To the extent permitted by law, Child Safe Sport’s total liability in connection with the platform is limited to the amount paid by the organisation to Child Safe Sport during the previous 12 months.
Changes to Terms
Continued use of the platform after updated terms take effect constitutes acceptance of the revised Terms.
Governing Law
These Terms are governed by the laws of Queensland, Australia. Any disputes will be subject to the jurisdiction of the courts of Queensland.
